TERMS & CONDITIONS
Effective Date: October 6, 2026
Last Updated: October 6, 2026
Welcome to SWAG Kennels Inc. (“SWAG Kennels,” “SWAG,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of
https://swagkennels.com/ (the “Website”) and your purchase or reservation of puppies or other services offered by SWAG Kennels.
By accessing the Website, contacting us, submitting an inquiry, placing a deposit, purchasing a puppy, or otherwise engaging in a transaction with SWAG Kennels, you acknowledge that you have read, understood, and agreed to these Terms, together with any written puppy-specific agreement, health guarantee, invoice, payment agreement, shipping agreement, or other terms provided to you by SWAG Kennels.
If you do not agree with these Terms, please do not use the Website or purchase from SWAG Kennels.
1. ABOUT SWAG KENNELS
SWAG Kennels Inc. is a dog breeder based in Washington State. We specialize in breeding and raising XL and XXL American Bullies and French Bulldogs.
Our Website may contain information regarding available puppies, adult dogs, bloodlines, pedigrees, colors, expected characteristics, pricing, deposits, financing, transportation, and other information relating to our dogs.
SWAG Kennels may update, change, suspend, or discontinue portions of the Website or its offerings at any time.
2. ELIGIBILITY TO PURCHASE
You must be legally capable of entering into a binding contract to purchase a puppy.
By purchasing a puppy, you represent that:
- You are at least 18 years old, unless otherwise permitted by applicable law.
- The information you provide to SWAG Kennels is accurate and complete.
- You are legally permitted to own the dog in the location where the dog will reside.
- You will comply with all applicable federal, state, county, municipal, housing, insurance, breed-specific, and animal-control requirements applicable to ownership of the dog.
- You will provide appropriate food, shelter, veterinary care, exercise, training, socialization, and humane treatment throughout the dog's life.
SWAG Kennels may decline a sale or reservation when reasonably necessary to protect the welfare of the dog or comply with applicable law.
3. PUPPY AVAILABILITY
All puppies and dogs are subject to availability.
A puppy displayed on the Website may be unavailable, already reserved, sold, or otherwise no longer available. Website listings, photographs, descriptions, prices, availability, and estimated dates may change without notice.
A puppy is not considered reserved until SWAG Kennels has confirmed the reservation and received the applicable deposit or payment.
4. PHOTOGRAPHS, COLORS, SIZE, AND APPEARANCE
Photographs on the Website are provided for illustrative and informational purposes.
Because dogs are living animals, their appearance and characteristics can change as they mature. Adult size, weight, height, color development, structure, temperament, and other physical characteristics cannot be guaranteed unless expressly stated in a separate written agreement.
Color descriptions and other physical descriptions are based on information available at the time and may vary as a puppy matures.
Statements concerning expected size, temperament, structure, bloodlines, or future appearance are estimates and are not guarantees of a particular outcome.
5. HEALTH INFORMATION
SWAG Kennels states that puppies are provided with a health certificate as applicable to the puppy and transaction.
Any veterinary examination, vaccination, deworming, health certificate, registration, pedigree, or other documentation provided with a puppy will be identified in the puppy's transaction documents.
A health certificate or veterinary examination represents the animal's condition at the time of examination and does not constitute a guarantee that the puppy will never develop an illness, congenital condition, hereditary condition, orthopedic condition, or other medical issue.
Prospective purchasers are strongly encouraged to have their puppy examined by a licensed veterinarian promptly after taking possession and to maintain regular veterinary care thereafter.
Any specific health guarantee offered by SWAG Kennels will be governed by the separate written health guarantee applicable to the puppy. If a separate written health guarantee conflicts with these general Terms regarding the puppy's health, the specific written health guarantee will control that issue.
6. GENETICS, HEREDITARY CONDITIONS, AND VETERINARY CARE
Dogs, including purebred and designer or specialty-bred dogs, may develop inherited, congenital, environmental, behavioral, or other medical conditions.
SWAG Kennels does not represent that a puppy is genetically free from every possible disease or condition unless expressly stated in a written agreement.
Purchasers are responsible for ongoing veterinary expenses, vaccinations, parasite prevention, food, training, insurance, licensing, and other costs associated with ownership.
Nothing on the Website constitutes veterinary, medical, behavioral, or legal advice.
7. DEPOSITS AND RESERVATIONS
A deposit may be required to reserve a puppy.
Unless otherwise stated in a written agreement provided to you, a deposit does not constitute transfer of ownership and does not by itself create a guarantee regarding the puppy's future characteristics.
Deposit terms, including whether a deposit is refundable, transferable, or forfeited following cancellation, will be governed by the written terms provided at the time the deposit is accepted.
SWAG Kennels may apply a deposit toward the purchase price of the puppy as specified in the applicable invoice or purchase agreement.
Customers should not submit a deposit unless they understand and agree to the applicable deposit terms.
8. PURCHASE PRICE AND PAYMENT
The purchase price for a puppy will be communicated to the customer before the transaction is completed.
Unless otherwise stated in writing, prices do not necessarily include transportation, shipping, airline charges, flight nanny fees, customs charges, import requirements, veterinary expenses, taxes, government fees, or other third-party expenses.
SWAG Kennels currently indicates that it accepts certain payment methods, which may include wire transfer, Zelle, Venmo, Cash App, and other approved methods. Available payment methods may change.
Customers are responsible for confirming payment instructions directly with SWAG Kennels before sending funds.
SWAG Kennels will not be responsible for funds sent to an unauthorized third party or fraudulent account. Customers should independently verify payment instructions before completing a transfer.
9. FINANCING
SWAG Kennels may make financing options available through SWAG Kennels or a third-party financing provider.
Financing may be subject to separate eligibility requirements, disclosures, contracts, interest, fees, and other terms imposed by the applicable financing provider.
Unless expressly stated in writing, SWAG Kennels is not the lender and does not control a third-party financing provider's approval decisions or terms.
Nothing in these Terms creates a loan, lease, installment ownership arrangement, or financing agreement.
Any financing arrangement must comply with applicable federal and Washington law.
10. OWNERSHIP AND TRANSFER
Ownership of a puppy transfers only according to the terms of the applicable written purchase agreement and after all required conditions for transfer have been satisfied.
Nothing in these Terms is intended to create a lease of a dog or an arrangement in which ownership of a dog remains contingent upon future payments after possession has transferred where such an arrangement is prohibited by applicable law.
Washington law specifically provides that certain contracts transferring possession of a live dog or cat while making ownership contingent upon subsequent payments are void and unenforceable. Accordingly, all transactions will be structured and administered in accordance with applicable law.
11. SHIPPING AND DELIVERY
SWAG Kennels may offer domestic and international transportation.
Transportation arrangements may include professional flight-nanny services, airline transportation, ground transportation, or other methods depending on the destination, puppy, applicable regulations, and availability.
Domestic shipping costs may vary based on destination and transportation arrangements. International transportation costs and requirements vary substantially by country.
The customer is responsible for providing accurate delivery information and complying with applicable import, quarantine, vaccination, licensing, customs, and animal-entry requirements in the destination jurisdiction.
For international transactions, the customer is responsible for applicable customs duties, import fees, taxes, permits, quarantine costs, broker fees, and other government or third-party charges unless expressly agreed otherwise in writing.
Transportation schedules are estimates and may be affected by airline restrictions, weather, health requirements, government regulations, delays, cancellations, or other circumstances outside SWAG Kennels' reasonable control.
12. INTERNATIONAL SALES
Customers purchasing a puppy for delivery outside the United States are responsible for determining whether the puppy may legally enter the destination country or jurisdiction.
SWAG Kennels may assist with reasonable transportation coordination, but customers remain responsible for complying with the laws of the destination country and any transit jurisdictions.
SWAG Kennels does not guarantee that a destination country will permit entry of a particular breed, age, sex, color, or animal.
If governmental authorities deny entry or impose additional requirements, the customer is responsible for resulting costs unless otherwise agreed in writing.
13. CUSTOMER RESPONSIBILITY FOR LOCAL LAWS
Before purchasing a puppy, customers are responsible for determining whether ownership is permitted at their residence.
This may include:
- City and county animal-control laws.
- Breed-specific restrictions.
- Homeowners' association rules.
- Rental or landlord restrictions.
- Insurance restrictions.
- Licensing requirements.
- Import or quarantine requirements.
- Weight or animal-number restrictions.
- Housing restrictions.
- Other applicable governmental or private restrictions.
SWAG Kennels does not guarantee that a purchaser's landlord, insurer, homeowners' association, municipality, county, state, or country will permit ownership of the dog.
14. REGISTRATION AND PEDIGREE
Where applicable, SWAG Kennels may provide registration or pedigree documentation.
The Website may reference American Bully Kennel Club (“ABKC”) registration or other registration documentation.
Registration organizations maintain their own rules and requirements. SWAG Kennels cannot guarantee that a third-party registry will accept, recognize, or maintain registration after a sale if the registry's requirements are not satisfied.
Registration status, pedigree information, and documentation will be governed by the records and terms applicable to the individual puppy.
15. BREED CHARACTERISTICS AND TEMPERAMENT
Every dog is an individual.
While SWAG Kennels may describe its breeding program and expected temperament, no representation should be interpreted as a guarantee that a puppy will have a particular adult personality or behavior.
Temperament is influenced by genetics, socialization, training, environment, handling, nutrition, veterinary care, and other factors.
Customers are responsible for appropriate training, supervision, socialization, and responsible ownership.
16. CUSTOMER INFORMATION
When contacting SWAG Kennels, requesting information, reserving a puppy, or purchasing a puppy, you agree to provide accurate information.
This may include your name, contact information, address, identification information, destination information, veterinary information, and other information reasonably necessary to complete a transaction.
You authorize SWAG Kennels to use such information to communicate with you, process transactions, coordinate transportation, provide documentation, and otherwise perform its obligations relating to your transaction.
For information about personal information collected through the Website, please review the Website's Privacy Policy.
17. WEBSITE CONTENT
The Website and its contents, including photographs, text, graphics, logos, videos, descriptions, testimonials, and other materials, are owned by or licensed to SWAG Kennels unless otherwise stated.
You may not reproduce, copy, distribute, modify, publish, sell, or commercially exploit Website content without prior written permission.
Third-party names, trademarks, social-media accounts, registries, and other third-party intellectual property remain the property of their respective owners.
18. TESTIMONIALS AND THIRD-PARTY INFORMATION
The Website may contain customer testimonials, reviews, photographs, social-media content, or other third-party statements.
Testimonials reflect the individual experiences and opinions of the persons providing them and do not guarantee that another customer will have identical results.
Any references to public figures, athletes, celebrities, or other individuals are presented only as stated in the applicable Website content and should not be interpreted as an endorsement unless expressly stated.
19. WEBSITE AVAILABILITY AND ACCURACY
SWAG Kennels attempts to keep Website information accurate and current but does not warrant that the Website will always be available, uninterrupted, error-free, complete, or current.
Information may change without notice.
We reserve the right to correct errors, omissions, pricing mistakes, typographical errors, and other inaccuracies.
20. PROHIBITED USE
You agree not to:
- Use the Website for unlawful purposes.
- Submit fraudulent or misleading information.
- Attempt to interfere with Website security or operation.
- Scrape, copy, or commercially exploit Website content without authorization.
- Impersonate another person or business.
- Attempt to obtain another person's confidential information.
- Use the Website to facilitate unlawful animal sales, animal cruelty, fraud, or other illegal activity.
21. LIMITATION OF WARRANTIES
To the maximum extent permitted by applicable law, the Website is provided on an “as available” and “as is” basis.
SWAG Kennels makes no warranties concerning uninterrupted Website availability or that Website content will be completely free from errors.
Nothing in these Terms excludes or limits any warranty, right, remedy, or protection that cannot lawfully be excluded or limited under applicable federal or Washington law.
22. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, SWAG Kennels will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Website or a transaction, except to the extent such limitation is prohibited by law.
Nothing in these Terms is intended to waive, limit, or eliminate liability that cannot legally be waived or limited.
Nothing in these Terms limits a customer's rights or remedies under applicable consumer-protection laws, animal-sale laws, or other mandatory laws.
23. FORCE MAJEURE
SWAG Kennels will not be responsible for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, severe weather, transportation interruptions, airline cancellations, governmental restrictions, disease outbreaks, emergencies, acts of war, civil unrest, labor disruptions, or other extraordinary circumstances.
Where appropriate, SWAG Kennels will work with the customer to determine a reasonable alternative arrangement.
24. THIRD-PARTY SERVICES
The Website may contain links to third-party websites, payment services, social-media platforms, financing providers, transportation providers, registries, or other services.
SWAG Kennels does not control third-party websites or services and is not responsible for their content, policies, security, availability, or practices.
Your use of a third-party service may be subject to that third party's separate terms and privacy policies.
25. DISPUTES AND GOVERNING LAW
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Before filing a legal action relating to a transaction, the parties are encouraged to communicate in good faith and attempt to resolve the issue informally.
Nothing in this section prevents a consumer from exercising rights or remedies that cannot legally be waived under applicable law.
Any dispute that cannot be resolved informally shall be brought in a court of competent jurisdiction as permitted by applicable law.
26. WASHINGTON CONSUMER RIGHTS
Nothing in these Terms is intended to waive or limit rights provided to consumers under Washington law.
Washington's Consumer Protection Act prohibits unfair or deceptive acts or practices in trade or commerce. WWashington State Legislative App
If any provision of these Terms conflicts with a mandatory requirement of Washington law or applicable federal law, the mandatory legal requirement will control to the extent of the conflict.
27. COMPLIANCE WITH ANIMAL-WELFARE LAWS
SWAG Kennels will conduct its business subject to applicable animal-welfare and animal-control laws.
Washington law imposes requirements concerning the keeping and breeding of dogs, including requirements applicable to persons maintaining more than certain numbers of intact dogs. WWashington State Legislative App
Customers are likewise responsible for complying with animal-welfare, licensing, vaccination, ownership, and animal-control requirements applicable to them.
28. CHANGES TO THESE TERMS
SWAG Kennels may update these Terms from time to time.
The revised Terms will become effective when posted on the Website unless a different effective date is stated.
The Terms applicable to a completed purchase will not be changed retroactively in a manner that unlawfully eliminates rights or obligations already established under a separate written purchase agreement.
29. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
The invalid provision will be enforced to the greatest extent legally permissible consistent with its original purpose.
30. NO WAIVER
A failure by SWAG Kennels to enforce a provision of these Terms does not constitute a waiver of its right to enforce that provision later.
31. ENTIRE AGREEMENT
These Terms, together with any applicable written purchase agreement, invoice, health guarantee, shipping agreement, financing agreement, and other documents expressly incorporated into the transaction, constitute the applicable agreement between SWAG Kennels and the customer concerning the subject matter covered by those documents.
If a specific written puppy purchase agreement conflicts with these general Website Terms, the specific written agreement will control to the extent of the conflict.
32. ELECTRONIC COMMUNICATIONS
By communicating with SWAG Kennels electronically, you consent to receiving transaction-related communications electronically where permitted by applicable law.
Electronic records and electronic signatures may have legal effect under Washington law. Washington law generally recognizes electronic records, electronic signatures, and electronic contracts. WWashington State Legislative App+1

I would make
three additional documents/pages for the site rather than trying to put everything into these Terms:
- Privacy Policy — because the site collects names, emails, phone numbers and other contact information.
- Puppy Purchase Agreement / Health Guarantee — this should contain the actual deposit, refund, warranty, veterinary-exam, congenital/hereditary-condition, return, and ownership terms for each puppy.
- Shipping & Payment Policy — your current page already says U.S. shipping is generally $850–$1,350, international shipping is available, and a deposit is required. SSWAG Kennels
There is also a
potential compliance issue worth addressing on the website itself: Washington's current RCW 16.52.360 contains specific requirements for certain retail pet-store dog sales, including website advertising requirements. Whether those provisions apply to SWAG Kennels depends on how the business is legally classified and operates; I would have a Washington attorney confirm that classification rather than assuming the statute does or does not apply. WWashington State Legislative App
This draft is not a substitute for review by a Washington attorney, particularly because SWAG Kennels sells live animals, accepts deposits/financing, and ships internationally. I intentionally avoided overly aggressive “no refunds/no liability under any circumstances” language that could conflict with mandatory consumer protections.
